Effective Dispute Resolution Process

  • Assist the Head of Unit in rendering legal referral and advisory services to the internal department and units within Air Selangor in respect of any dispute resolution matters.
  • Assist the Head of Unit in identifying legal issues arising from the dispute resolution matters and thereafter, strategising and executing the necessary legal actions including if required, the appointment and management of external solicitors.
  • Assist the Head of Unit to oversee the dispute resolution process is effectively carried out by the appointed external solicitors and to give the necessary instruction to the appointed external solicitors for the purpose of obtaining high quality legal services.
  • Assist the Head of Unit to attend all hearings, mediations, meetings and/or discussion related to the Company's dispute resolution matters including participating and taking notes of such proceedings.
  • Assist the Head of Unit to identify and recommend any ongoing dispute resolution matters that may be resolved by way of out of court settlement including to negotiate and finalise the terms and conditions of such proposed settlement.
  • Assist the Head of Unit to continuously monitor and update the progress of any ongoing dispute resolution matters including to regularly update the Head of Unit and/or the Head of Corporate Affairs on the outcome and/or directive given by the judge / arbitrator.

Draft, Review and Finalise all Cause Papers and any other ancillary documents

  • Assist the Head of Unit to draft, review and comment any letter of demands, respond to the letter of demands, cause papers and any other relevant legal documents relating to the ongoing civil litigation / arbitration proceedings prepared by appointed external solicitors and working alongside the appointed external solicitors in the preparation and finalisation of court documents.
  • Assist the Head of Unit to prepare and finalise any paper to the Management, the CEO and/or the Board of Directors for the purpose of updating or obtaining decision in respect of any ongoing dispute resolution matters.

Conduct Legal Research

  • Assist the Head of Unit to conduct legal research and providing complete, accurate and timely legal opinion(s) to other departments / regional offices based on the relevant laws as and when necessary.
  • Assist the Head of Unit to procure appointed external solicitors to issue legal opinion(s) to the Board of Directors, as and when requested, in respect of any legal issues arising from the ongoing dispute resolution matters.

External Solicitors and others

  • Assist the Head of Unit to procure the services of external solicitors, consultants and/or expert witness to represent Air Selangor in relation to any dispute resolution matters.
  • Assist the Head of Unit to review the documentary evidence and merits of cases which go for trial together with external lawyers.
  • Assist the Head of Unit to strategise and coordinate with external lawyers in rendering legal advisory and support services to relevant department / section / unit including attending to strategic internal or external communication and preparation for the ongoing dispute resolution matters.
  • Assist the Head of Unit to regularly review and monitor the performance of the appointed external solicitors for the purpose of ensuring the services rendered meet the needs of the Company.

Meetings and Consultations

  • Assist the Head of Unit to organise any internal and/or external meetings with the external solicitors, consultants and/or expert witness together with the relevant department / section / unit for the purpose of attending to the ongoing dispute resolution matters.

Internal Training / Workshop

  • Assist the Head of Unit to plan and organise yearly training and workshop programs for stakeholders and/or employees on various legal topics in connection with existing or potential dispute resolution matters that are related to the Water Services Industry Act 2006, the Companies Act 2016, the National Land Code 1965, the Competition Act 2010 and/or any other relevant governing laws.

Invoices

  • Assist the Head of Unit to validate and prepare the payment memorandum and to process invoices from the appointed external solicitors, consultants, expert witness and/or any third party in relation to any ongoing dispute resolution matters including to ensure that such invoices are proportionate to work done and in accordance with the agreed fees.

Reports

  • Assist the Head of Unit to prepare reports such as KPI Report, On-Going Report, Matters Arising Reports and submit the same for Head of Unit's approval within the set timeline.

Other Duties

  • Assist the Head of Unit to plan, develop and implement OPEX Budget for the Dispute Resolution Unit and to monitor such budget utilisation and control are within the Approved Budget.
  • Assist the Head of Unit to regularly update the Dispute Resolution Unit on any changes to the governing laws and to further advise the Company of such relevant changes and its impact towards the Company.
  • Perform any other duties and responsibilities as may be assigned by the Head of Corporate Affairs and/or Head of Unit from time to time.
