Senior Legal Counsel, Procurement Legal Advisory

ROLE PURPOSE

Senior Legal Counsel (Procurement) is responsible to provide expert legal guidance and support to drive an effective and efficient procurement infrastructure and framework aligned with the Bank's strategic priorities and outcomes.

This role involves drafting, reviewing and negotiating procurement contracts and related legal documentation, providing legal advice in the area of corporate/commercial law including contract law as well as develop and implement legal services standards and processes for an effective management of legal risks in the Bank's procurement framework.

Bank Negara Malaysia (the Central Bank of Malaysia), is a statutory body which started operations on 26 January 1959. Bank Negara Malaysia is governed by the Central Bank of Malaysia Act 2009. The role of Bank Negara Malaysia is to promote monetary and financial stability. This is aimed at providing a conducive environment for the sustainable growth of the Malaysian economy.

Bank Negara Malaysia's monetary policy stance is to maintain price stability while remaining supportive of growth. Bank Negara Malaysia is also responsible for financial system stability. This is achieved by developing a sound, resilient, progressive and diversified financial sector which serves to support the sectors of the real economy. It also plays an important function in implementing initiatives to deepen and strengthen the financial markets, including the foreign exchange market.

Bank Negara Malaysia has played a significant developmental role in developing the financial system infrastructure in advancing the financial inclusion agenda. This is to ensure all economic sectors and segments of the society have access to financial services. In addition, Bank Negara Malaysia also oversees the nation's payment systems infrastructure which emphasize on the efficiency and security of the financial systems.

As the banker and adviser to the Government, Bank Negara Malaysia provides advice on macroeconomic policies and the management of public debt. Bank Negara Malaysia is also the sole authority in issuing the national currency and in managing the country's international reserves.

PRINCIPAL ACCOUNTABILITIES

1. Drafting, reviewing and negotiating procurement contracts and project-related contracts for the
   
   Bank to ensure consistency and compliance with relevant laws/regulations to safeguard the
   
   Bank's interest.
2. Identify, assess and manage legal risks associated with procurement activities in the Bank.
3. Provide timely and quality legal advice to stakeholders to avoid or mitigate any potential legal risk during pre-contract and post contract phases.
4. Provide guidance to the legal team in analysing and identifying legal risks and implications in procurement transactions, reviewing and approving procurement contracts prepared by the team to ensure the interest of the Bank is protected.
5. Provide timely and quality legal advice on construction related laws including reviewing and negotiating construction related contracts to ensure regulatory compliance by the Bank and interest of the Bank is safeguarded.
6. Fostering and maintaining an effective collaborative working arrangement with Jabatan Undang-Undang centered on mutual trust, clear communication and transparency and a shared understanding of the Bank's principal objects and functions including legal risk management.
7. Drive the Bank's awareness and understanding of the legal and compliance standards through
   
   continuous socialisation and trainings.
8. Keep abreast of changes in all laws and standards to procurement to ensure the Bank remains
   
   compliant.

QUALIFICATIONS

Academic Qualifications:

1. A Bachelor's Degree in Laws (LL.B.) from a recognised university is mandatory. A Master of Law is an added advantage.
2. Admitted as an Advocate and Solicitor of the High Court of Malaya/Sabah & Sarawak is an added advantage.

Experience:

1. ≥ 10 years working experience in handling commercial and procurement contracts.
2. Experience in procurement contracts, intellectual property law and commercial contracts is an advantage.
3. Business acumen with ability to balance legal risks against commercial objectives.
4. Excellent in drafting, negotiation and communication skills.
5. Detailed-oriented, have strong analytical and problem-solving skills.
6. Ability to work independently and as part of a team.
