The Position We are looking to hire a passionate employment attorney to help support the HR teams and business managers across Intel's sites in Malaysia and, in time, Southeast Asia - Indonesia, the Philippines, Singapore and Thailand. The employment attorney must have a practical knowledge of Malaysia employment and labor laws and excellent inter-personal skills to build confidence in their advice and relationships. This is a fast-paced role in a lean but busy Employment Legal team dealing with a wide range of employment law legal issues. Reporting to the Senior Employment Counsel for Malaysia you will work your manager in providing a first class employment law service to all business divisions of Intel at Intel's sites across Malaysia. What you'll do Employment Law Advice and Consultation: Keeping Intel legal and our business operations compliant through strategic and proactive legal advice and consultation. In doing so, to respond in a timely manner and to consult/escalate to the Senior Employment Counsel for Malaysia or the Employment Law Director for GAR. Legal Compliance and Controls - You are expected to know / keep abreast of changes in the law in advance at each location where Intel's sites are -ensuring legal compliance and controls
- and advise on the consequences of non-compliance, as well as options/mitigations. Managing employee litigation cases - Managing and partnering closely with external counsel on employee litigation cases. Providing litigation strategy advice to the business and representing Intel at conciliation meetings or other hearings with the labor authority. Internal investigation work - Safeguard Intel's Culture and Values through investigations of statutory complaints e.g., Harassment. Advising other investigation teams and HR on what evidence would be required to secure safe terminations and to ensure a fair process is followed. Labor Relations - You are expected to understand Trade Union laws/practice, as needed, and work with the Employee and Labor Relations team - and Business HR in maintain positive Labor Relations with local Governments and other external bodies. People Movement Actions
- Exiting employees due to redundancy is always a last resort. However, from time to time, Intel Malaysia will experience restructuring and you are expected to partner with all relevant stakeholders in advising proactively on the legal and ER risks associated with these actions. Training - Providing learning and development training to HR, other legal teams and the business on employment law areas and doing so in an innovative way to engage fully with the audience. Labor authorities' relationship and partnership - Maintain healthy and strategic relationship with local labor authorities and partner with HR in regarding to new legislatives and compliance requirement, activate Intel's voice and mitigate ER risks as needed. Risk Management: To take a proactive approach in relation to the identification of risk and risk management, and to identify proactively, and guide the HR team and business in responding to labor law compliance or regulatory issues and legislative changes. Labor Law Changes: Actively monitor judicial and regulatory employment law rulings, legislative changes and developments in employment law/labor relations areas that may affect Intel's business or policies, work strategically with government affairs to influence the right direction and guide the Company's response. Travel - Given the different locations of Intel Malaysia's operations you may need to travel to the different sites mainly Penang and Kulim.
