Head Corporate TaxJOB PURPOSE
- Lead the overall corporate tax compliances and tax advisory for MISC Group, including but not limited to tax advisory, monitoring tax payment, tax audit, transfer pricing, etc. for the purpose of minimising tax liability and optimising tax benefits.
- Lead and provide guidance on appropriate tax advice relating to MISC Group's domestic & international tax strategy, coordinating external advice as necessary to create and maintain an optimum tax structure and minimising the Group's direct tax cost and exposure.
- Engage with the business to support the activities relating to MISC Group's domestic & international tax strategy and transfer pricing model.
- Act as a business partner for MISC Line of Business and subsidiaries, overseeing all tax matters.
- Ensure all global tax compliance obligations are met and tax returns are consistent with planning structures in place.
- Involved in all aspects of tax compliance, advisory and planning to ensure MISC Group's adherence to tax laws, regulations and reporting requirements.
PRINCIPAL ACCOUNTABILITIES:
Tax Compliance & Regulations
- Lead and manage the tax filing plan for the Group to ensure timely submission of annual tax returns for entities across MISC Group.
- Lead and maintain the Local and Global Group Transfer Pricing model and manage any associated risks.
- Provide guidance to ensure that all the entities in the Group comply with the relevant tax and transfer pricing related regulations where the entities operate.
- Lead analysis of changes in tax laws and regulations to ensure tax considerations are appropriately addressed and integrated and proactively recommend changes to internal processes or strategies as needed.
- Lead review of tax returns and transfer pricing documentation prepared by Service provider/in-house and tax queries/issues raised by internal stakeholders & external party.
- Lead the technical assessment of tax treatment/position taken across MISC Group.
- Oversee direct tax audits requested by internal or external parties.
- Oversee annual compliance including the identification of improvement opportunities to the tax compliance process and implement related process changes.
Tax planning/optimization
- Lead analysis of financial data to identify tax planning opportunities, including evaluating the tax implications of various business decisions and identifying areas for tax savings.
- Recommend optimum strategies on direct matters for the Group such as tax planning opportunities, managing cross-border tax exposure risk, avail for tax incentives/exemption, etc.
- Oversee implications of new tax rulings and legislations and provide recommendations for Groupwide applications (e.g. Global Minimum Tax).
Tax advisory & consultancy
- Partner with cross-functional teams to provide tax input on key business initiatives such as mergers and acquisitions, divestitures, and strategic investments.
- Lead and manage tax advisory and consultancy on direct tax matters for the Group including flow of funds to ultimate holding company and advising on tax implications of various business transactions and initiatives.
- Lead and manage cross-functional projects and initiatives to ensure tax considerations are appropriately addressed and integrated into business decisions.
- Lead and manage tax structuring, advice and addressing potential tax implications in Group-wide and Business Unit projects involving:
- Legal entity structuring
- Corporate tax
- Withholding tax
- Tax Incentives
- RPGT
Tax Governance
- Define overall compliance with related tax governance imposed by authorities such as Bursa, IRB, MOF, etc.
- Lead processes, framework and controls and ensure all are in place to manage and mitigate tax risks including periodic reviews for further enhancement.
- Oversee comprehensive tax impacted and end-to-end business process flows and internal controls for control improvements.
Periodic Health Check
- Lead on-site tax risk assessments and assess and present report findings with action required to relevant parties.
- Lead discussions with other departments where relevant to direct non-compliance tax issues noted to appropriate channels for investigation and resolution.
Tax Business Partnering
- Act as a business partner to the organization by providing comprehensive guidance and industry insights (e.g. exemptions and incentives) through collaboration with senior Finance and Business stakeholders to drive value creation.
- Act as a country focal person for all direct tax matters by providing Group concise advice and strategic perspectives by keeping abreast with evolving country specific tax laws to manage risk exposure and future business expansions.
Group Tax Knowledge sharing/ Awareness sessions
- Lead and manage continuous knowledge awareness sessions for the Group on direct and international tax matters.
- Act as a line trainer for Skilled Group.
Networking and relationship building
- Establish and maintain networks and relationships with tax authority and other relevant government agencies, tax consultants and subject matter experts to develop alliances or expand tax-related knowledge.
- Act as focal person for both internal and external parties.
Staff Development
- Develop, motivate and coach staff to ensure effectiveness in supporting the Group Tax department's functions and objectives.
EXPERIENCE:
- At least 15 years of working experience in taxation function, with significant exposure in both big four firms and corporate environments.
- Exposure in senior managerial capacity/position and possess a working appreciation of the role and orientation of the top management.
QUALIFICATION:
- Degree in Accounting/Finance/Business or equivalent.
- A member of ACCA/ICAEW/CTIM would be an added advantage.
