Core Competency Requirements:

  • Bachelor's degree in Law (LLB) or equivalent; membership in the Bar is preferred.
  • At least 5 years of experience in property, real estate, or construction law.
  • Strong understanding of local property, land, and development laws.
  • Excellent contract negotiation and drafting skills.
  • Good communication, analytical thinking, and problem-solving skills.
  • Ability to manage multiple projects and tight deadlines.
  • Fluent in English and Bahasa Malaysia. Fluency in other languages would be an added advantage

Responsibilities:

  1. Provide comprehensive legal advice on laws and regulations related to property acquisition, ownership, disposals, leases, land matters, project developments, and other real estate transactions.
  2. Guide the National Land Code 1965 (NLC), Strata Titles Act 1985, Housing Development (Control and Licensing) Act 1966 (HDA), Town and Country Planning Act 1976, and related regulations.

  3. Interpret and advise on land tenure, title conversions, land dealings, charges, caveats, and easements.

  4. Draft, review, and negotiate:

  5. Sale and Purchase Agreements (SPA)

  6. Tenancy and lease agreements
  7. Joint Venture Agreements (JVA)
  8. Construction contracts and consultant agreements
  9. Land acquisition and disposal contracts
  10. Facility and management agreements

  11. Ensure that all agreements protect the company's interests and align with Malaysian law.

  12. Conduct comprehensive due diligence on land titles, ownership, encumbrances, and zoning.

  13. Ensure development and construction projects comply with local authority approvals, environmental regulations, and licensing requirements.

  14. Support applications for development approvals, planning permissions, subdivision, and strata title issuance.

  15. Oversee property-related litigation, arbitration, or mediation matters.

  16. Manage and liaise with external legal counsel on disputes involving contractors, buyers, tenants, and other stakeholders.

  17. Identify and mitigate legal risks associated with property investments and developments.

  18. Review internal processes to ensure compliance with corporate governance frameworks.

  19. Advise management on regulatory changes impacting property and housing development.

  20. Act as the company's representative with:

  21. State Land Offices & Pejabat Tanah dan Galian (PTG)

  22. Local Authorities (PBT)
  23. Ministry of Housing and Local Government (KPKT)
  24. Securities Commission (if involving REITs or listed property entities)
  25. Maintain effective relationships with government agencies to expedite approvals.

  26. Work closely with contractors, consultants, and external lawyers to ensure smooth project execution.

  27. Responsible for daily operational matters and any other ad hoc tasks assigned by the Management.
