Senior Legal Counsel, Legal Development

ROLE PURPOSE

• Provide in-house legal advice and services, as well as to assist the Bank in managing its legal risks and protecting its interests in the following matters─
  • drafting/vetting/reviewing primary and secondary legislation of the Bank
  • reviewing and providing feedback on policy and legislation by external stakeholders impacting the Bank and industries under the Bank's purview  
  • legal advice and solution on law, whistle-blowing and management of legal risks
  • surveillance and sharing on latest legal development impacting the Bank  
  • relevant legal research and providing feedbacks on current and new laws impacting the Bank  
  • any other matters as instructed by Deputy General Counsel/General Counsel
• Manage and guide associate legal counsels/legal counsels in providing the above legal services 

PRINCIPAL ACCOUNTABILITIES  

1. Assist the Bank in managing its legal risks and protecting its interests by providing the following services and managing and guiding Legal Counsels and Associate Legal Counsels in providing the following services─

• Legislative Drafting
  • Drafting of new or amendment to primary and subsidiary legislation (not including Policy Documents) administered by the Bank  
  • Custodian of legal laundry list (namely list of legal provisions for amendment)
• Law Review
  • Reviewing and providing feedback on policy and legislation by external stakeholders impacting the Bank and industries under the Bank's purview  
  • Conduct review of items included the laundry list to determine the necessity of amendment
• Legal Knowledge, Learning and Awareness
  • Monitoring and research on domestic law development & updates via articles in KijangNet or any other platform approved by the Bank (VivaEngage, etc.)  and memo to MC (if needed).  
  • Where relevant, suggest countermeasures to legal development that has impact on the Bank
  • Conduct KSS session (whether JUN internal or Bank wide) on new legal development.
  • Conduct training to client departments on legal drafting for PD.
  • Assume the role of Department Learning Officer (DLO)
• Whistleblowing
  • Assist Deputy General Counsel and a team of legal counsels in management of whistleblowing reports on behalf of General Counsel as one of the Designated Persons  
• Legal Risk Management
  • Coordinate the reporting of and response to legal risks identified from transactions and activities of the Bank to relevant forum or platforms within the Bank
• Business Continuity Planning, Information Asset Planning, 3rd Party Security Assessment
• Any other matters as instructed by Deputy General Counsel/General Counsel

2. Effectively participate in meetings, committees, taskforce and project of the Bank or the department to assist the Bank in managing its legal risks and protecting its interests. 

QUALIFICATIONS & EXPERIENCE

Academic Qualifications: 

• Bachelor of Laws with Honours (LL.B. (Hons). Masters degree or PhD in legal field related to the role's purpose and responsibilities is an added advantage.  

Experience: 

• Minimum of 6 years working experience in rendering legal services as an in-house legal counsel in a statutory body, a corporate entity or the financial industry, or as a legal practitioner in the Judicial and Legal Service or private legal practice. Working experience with a financial regulatory authority is an added advantage.

TECHNICAL SKILLS/KNOWLEDGE

• Intermediate to advance level of knowledge on Malaysian legal system and common law approaches to statutory interpretation;
• Intermediate to advanced level of knowledge on-
  • Powers, responsibilities, limitations and liabilities of a statutory body and regulatory authority;
  • regulatory laws administered and financial industry regulated by the Bank;
  • financial market, financial agreements and Islamic finance;  
  • governance and corporate management;  
  • enforcement; and
  • legal risks management;
• Intermediate to advanced level of skills on legal advisory, legal drafting, legal research, legal interpretation, leadership, analytical thinking and problem-solving;
• Basic to intermediate level of computer skills including Microsoft Outlook, Teams, Edge, Word and Power Point, and online legal databases (e.g. LexisNexis, Lawnet, CLJ).
